Ruben Flores, 80, was arrested and charged with accessory to murder in connection with Smart's abduction last week. The sheriff's office searched Ruben Flores' property again in March, roughly a month before he and his son were detained. According to investigators, Smart's remains have yet to be discovered.

Kristin was last seen on February 10th when she left her home in Canyon Lake, California at about 6:30 PM to go for a walk. She never returned. There were no signs of violence outside of her home and it appears that nobody saw or heard from her after she went out for her walk. Her car was found the next day in a parking lot near her workplace. Police say there was evidence that it had been driven recently. They also say there was blood inside the car related to Kristin's case.

Her father, Robert Smart, believes his daughter was abducted by someone she knew. He said during an interview that she would never go anywhere without telling anyone where she was going. He also said that she has several scars all over her body that she got while she was living in Mexico. One of them is on her neck and looks like it was caused by a rope.

Smart worked as a medical transcriptionist for Healthfirst Medical Transcription Services. She lived in Canyon Lake with her two sons, ages 4 and 7. Police say they are still looking for any other potential witnesses or suspects.

Although it is unusual for the San Luis Obispo County District Attorney's Office to prosecute a murder charge in the absence of a body, comparable cases have been successfully tried in the past. The case against him was made solely on the basis of forensic evidence that pointed to Paulson as the killer. Smart had been strangled to death with one of her own necklaces; there were fingermarks on her chest that matched those of David Paulson; and a blood-stained t-shirt worn by Paulson the night of the murder matched the stain pattern on his jacket.

In addition, police officers searching Paulson's house found letters from Smart telling him where he could find her body. She had planned to meet him at a local park but didn't show up. When police told him they believed she was dead, he confessed right away.

Kristin Smart was last seen alive by her mother around 7:30 p.m. on February 10, 1990. Her car was found the next morning at an abandoned farmhouse several miles from where she lived. There were no signs of violence outside the house or inside, except for some minor damage to the front end of the vehicle.

In November 1998, Daniel and Danny Smart were each sentenced to six years in prison after being convicted of second-degree murder for their part in their sister's death. It was the first time in California history that minors had been convicted of a felony homicide. The judge ordered the boys to serve their sentences consecutively, which means they will not get out until they are 36 years old.
